Litigation Funding in Australia industry analysis

Australia’s Litigation Funding industry is still relatively new, largely due to champerty laws being revoked about two decades ago. These laws used to prohibit third parties from funding lawsuits in exchange for a portion of the plaintiff's proceeds. With these laws removed, litigation funding companies have emerged, selectively choosing the cases they fund as they earn a percentage of the settlement fee only when a case is successfully concluded. This creates significant variability in the industry's revenue and profit, as both largely depend on inconsistent settlement payments. Revenue plunged at the start of the period as a consequence of the pandemic, but climbed substantially in 2022-23 as backlogs cleared. Overall, industry revenue is expected to contract at an annualised 13.7% over the five years through 2025-26, to total $123.6 million.

Trends and Insights

  • Litigation funders face high financial risk, which is why they rigorously select cases with strong prospects. This contributes to high wage costs, which have weighed on industry profitability over the past few years amid falling revenue.
  • Consumer protection lawsuits can involve class action claims on behalf of large groups of people. The frequency of class action lawsuits is increasing and they generate strong windfalls for funders when they do occur.
  • Capital cities account for disproportionate shares of litigation funding offices. Funders in capital cities benefit from proximity to clients and the courts where matters are heard.
  • High barriers to entry compound the industry’s significant level of concentration, as many litigation funders can encounter difficulty entering the industry. New litigation funders can struggle to attract investments and establish workforces with the necessary expertise.

Industry Statistics and Trends

Market size and recent performance (2015-2030)

Industry revenue has declined at a CAGR of 13.7 % over the past five years, to reach an estimated $123.6m in 2025.

Trends and Insights

Case selection and high wage costs influence funders’ performance

  • Players in the Litigation Funding industry provide funding to parties involved in lawsuits in return for a portion of the settlement proceeds if the court ruling is favourable. The funder typically covers costs associated with the case, including legal fees for solicitors and barristers, as well as other expenses like expert reports. Litigation funding is provided on a non-recourse basis, meaning the funder loses all of the money lent to the client if the ruling is unfavourable.

Trends and Insights
